Terms of Service

1. Introduction

These Terms of Service regulate and define the relationship between HEO Systems, herein referred to as the 'Provider,' 'Company,' or 'HEO Systems,' and clients, customers, and users such as guests. By using our services, you automatically agree to all conditions mentioned within this agreement, so please read and understand this document carefully. Our services are diverse, and additional terms may be mentioned at various 'checkpoints' throughout our platforms. You, as the user, must abide by these terms and services. By accessing our service, you acknowledge, understand, and agree to the following terms and conditions as stated within this agreement, along with the terms and conditions stated in our Privacy Policy. HEO Systems will ensure any written information will be easy to understand. In the event any doubt or questions arise, please contact our support team immediately. HEO Systems values all our clients, and as such, your security, safety, and accountability are exceptionally important to us.

2. Binding Agreement

By registering with, accessing, or otherwise using this website and our services, you hereby agree to be bound by these Terms of Service set forth below. The mere use of this website implies the knowledge and acceptance of these Terms of Service. In some particular cases, we can also ask you to explicitly agree.

3. Eligibility to Use

HEO Systems cannot legally allow individuals to use the platform if:

you are not able to form legally binding contracts
you are under the age of 13
you are under the age of 18 without parental/legal guardian consent
you are barred from receiving and rendering services under the laws of The Netherlands or another applicable jurisdiction
you are suspended from using the Website
you do not hold any valid form of communication between you and the website
your details are flagged by our Anti-Fraud system as carrying a high risk
you are subject to sanctions or otherwise designated on any list of prohibited or restricted parties maintained by the United Nations Security Council, The Netherlands, or any other applicable government authority

We may, at our absolute discretion, refuse to register any person or entity as a User. You cannot transfer or assign any rights or obligations you have under this agreement without prior written consent.

4. Changes to These Terms

HEO Systems reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Site following the posting of any changes to this Agreement constitutes acceptance of those changes. We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether. You can stop using our Services at any time, although we will be sorry to see you go. We may also stop providing Services to you or add or create new limits to our services.

5. Account Creation and Security

When registering an account, you automatically agree to these terms of service and the privacy policy to gain access. You agree to:

not share your account credentials
take responsibility for the actions of the account
be responsible for the security of the account
not exploit any flaws in hardware or software
not attempt to circumvent any security features
report exploits and security flaws upon discovery
not perform any attacks on any network, host or servers
not engage in activities that interrupt or interfere with HEO Systems services
not engage in illegal activities

You are responsible for maintaining the confidentiality of passwords and account information. After account termination, you will not attempt to register a new account without our permission.

6. Payments, Billing and Renewals

On all hosting plans we enforce the following renewal, suspension and termination policy:

Invoices are typically generated 7 days before the service is due
Once invoiced, a service cannot be upgraded, downgraded, or otherwise adjusted
If unpaid, the invoice will be marked as overdue at 11 AM GMT+2 the day after the service is due
If the service remains unpaid, it will be suspended and cannot be accessed
After 3 days from the due date, it will be terminated
For automatic billing through Stripe and PayPal, we will attempt to charge your payment method on the due date and the following two days
You are responsible for ensuring manual payment if automatic attempts fail

7. Refunds and Cancellations

Within 2 days (48 hours) of receiving your service, we may offer a refund for Minecraft Hosting, Discord Bot Hosting, Website Hosting, and SteamCMD Game hosting. Limitations apply:

Add-ons are non-refundable
Dedicated Servers and custom orders are non-refundable
Processed cancellations are non-refundable
Previous refunds within two months make you ineligible
Upgrade orders are non-refundable
Backup restores make services ineligible
Self-caused downtime is non-refundable

Cryptocurrency payments can only be refunded to account credit. We reserve the right to deny refunds at any time.

8. Account Credit

HEO Systems account credit cannot be withdrawn to any payment method. Credit automatically expires on January 1st each year at 50% of the total balance, with a minimum expiration of $25. Users can preserve credit by requesting during January. This policy encourages regular service use and maintains accurate records. Account credit can only be deposited, and our refund policy does not apply to it.

9. Affiliate Program

HEO Systems operates an affiliate program for client referrals in return for credit. Withdrawals are for HEO Systems account credit only. Promotional, review, and discount sites are not allowed. Affiliate links must be clearly visible and not masked. We reserve the right to refuse payouts and close accounts for system abuse. Certain products like Dedicated servers may not have affiliate payouts.

10. Service-Specific Terms

For Minecraft servers:

RAM is provided based on the plan ordered, with unlimited slots subject to CPU capacity
Disk space is unmetered with fair-use policy
Automatic backup plugins are not allowed

For MySQL Services:

One free database per Minecraft server, with size limits and fair usage policies

For VPS and VDS:

Subject to fair use for CPU, network, and disk resources

For Dedicated Servers:

Users must not engage in illegal activities, with specific bandwidth and usage policies

For Web Hosting:

No illegal or nulled sites, no background processes or high CPU usage permitted

11. Backups and Data Loss

We provide offsite backups based on service level. A $7.50 restore fee applies for services without backup packages. MySQL database backups are accessible with Premium/Extreme plans or for a $2.50 fee. We recommend maintaining your own backups as we are not responsible for data loss.

12. Support Services

We aim to respond within 30 minutes to tickets, though complex requests may take longer. Ticket spamming or abusive behavior may result in support system bans. Live chat is for pre-sales only. Services are unmanaged unless specified otherwise.

13. Advanced Support Add-ons

Advanced Support Add-ons are non-refundable and service-specific. For Minecraft, this includes plugin installation, map uploads, and configuration assistance. For Linux, it includes basic service setup and debugging. Support terms specify service limitations and requirements.

14. Fair Use Policy

All services operate under fair use. While we offer features like unlimited slots or unmetered disk space, reasonable limitations prevent single customers from impacting service quality for others. Resources are monitored for equitable distribution.

15. Prohibited Activities

Services may be suspended or terminated without warning for abuse, including:

excessive CPU usage
unauthorized access attempts
DDoS activities
spam
illegal content distribution
cryptocurrency mining

Specific restrictions apply to different service types.

16. Intellectual Property

We or our licensors own all copyright and intellectual property rights in the website and its resources. You must obtain written permission before using, copying, or distributing our content commercially.

17. Indemnification and Limitation of Liability

You agree to hold HEO Systems free from stipulations, liability, and losses. We are not responsible for consequential, punitive, special, or incidental damages. All services are provided 'as is' without warranties.

18. Privacy and Electronic Communication

Your registration information must be accurate and up-to-date. We protect your privacy and will not use your email for unsolicited mail. Electronic communications satisfy legal writing requirements.

19. Termination

HEO Systems may refuse, cancel, or terminate services at its discretion for violations or at management discretion. Terminated accounts will not be refunded. We reserve the right to terminate service with or without notice.

20. Legal Compliance

Access from territories where our services are illegal is prohibited. You may not use this website in violation of Dutch export laws and regulations.

21. Entire Agreement

These Terms of Service, together with our privacy statement and cookie policy, constitute the entire agreement between you and HEO Systems. Failure to enforce any provisions does not waive our right to enforce them.

22. Choice of Law and Jurisdiction

These Terms of Service are governed by Dutch law. Disputes are subject to Dutch courts' jurisdiction. Invalid provisions will be modified or deleted to maintain maximum permissible effect.
